GDPR FAQ

What is the GDPR?

The General Data Protection Regulation (GDPR) is a new European privacy law that goes into effect on 25 May, 2018. The GDPR will replace the EU Data Protection Directive, also known as Directive 95/46/EC, and will apply a single data protection law throughout the EU. Data protection laws govern the way that businesses collect, use, and share personal data about individuals. Among other things, the GDPR requires businesses to process an individual’s personal data fairly and lawfully, allow individuals to exercise legal rights in respect of their personal data (for example, to access, correct or delete their personal data), and ensure appropriate security protections are put in place to protect the personal data they process.

Who does the GDPR apply to?

The GDPR applies to all entities operating within the EU and to entities outside the EU that offer goods or services to individuals in the EU. The GDPR defines personal data as any information relating to an identified or identifiable natural person. This is a broad definition, and includes data that is obviously personal (such as an individual’s name or contact details) as well as data that can be used to identify an individual indirectly (such as an individual’s IP address).

What personal data do we collect and store from our customers?

We and our third party partners collect, use, and store personal data as described in our Privacy Policy.

Do we transfer data internationally?

The GDPR replicates the Data Protection Directive restrictions on transferring data outside the EU and prohibits the export of personal data outside of the EU to non-EU recipients unless the export meets certain criteria.

Although we are headquartered in the United States, Professor Mysterious has customers in the EU. In certain circumstances, we will process personal data that originates from the EU in the United States.

How do we handle delete instructions from customers?

Customers have the ability to remove themselves from newsletter and marketing email lists. Likewise, customers may request to have their user account deleted and manually removed from email lists, however order history will still exist for Financial and Regulatory statutes. For data deletion or inquiries on how an EU citizen’s personal data is being stored, used, and where it is located please email pmff.eugdpr@professormysterious.com and your request will be acknowledged within 3 business days (Monday through Friday, excluding holidays) and addressed/resolved within 30 calendar days. Privacy Policy

This privacy policy describes the privacy practices for Mister-E-Liquid, LLC and its affiliate Professor Mysterious. This privacy policy applies solely to information collected from and about you when you access and use this website. (the “Services”).

This privacy policy describes:

  • What personal information and other information is collected from you through the Services, how it is used and with whom it may be shared
  • What choices are available to you regarding the processing of your information
  • The security procedures in place to protect your information
  • Your rights and choices with regard to your information

Types of Information Collected

Information You Provide.

Account Registration. When you register for an Account, we ask for your contact information, including items such as name, address, company name, email, and phone number. You will also be required to create a password. When you sign in to your account, we ask you to provide your login information (typically an email address and password) to validate you as a user.

Purchases. If you make a purchase through the site without registering for an account, we ask for your name, shipping and billing address, email address, and phone number. We also ask for the name, shipping address and/or email address of the recipient of products you have purchased if it is someone other than you. When you are placing an order at our site, we collect payment information, which is transferred to and processed through a 3rd party payment gateway and processor. We do not store your financial account information. We also do not have access to this information once an order has been placed or during the processing of payment.

User Content. Our product and company review community is voluntary. By submitting a review you agree that any information submitted, including your name, may be viewed by other customers and third parties we do not control.

Communications. If you contact us directly we may request additional information such as name, email, address, order number, phone number, and context for inquiry as necessary to fulfill your requests.

The personal information that you are asked to provide, and the reasons why you were asked to provide it, will be made clear to you at the point we ask you to provide your personal information.

Information Collected Automatically When You Use Our Site.

Cookies and Other Tracking Technologies. As is true of most websites, we and our analytics and advertising partners gather certain information automatically and store it in log files. In addition, when you use our Services, we may collect certain information automatically from your device. This information may include internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, clickstream data, landing page, and referring URL. To collect this information, a cookie or HTML5 local storage or local stored objects may be set on your computer or device when you visit our Services. This technology contains a small amount of information that allows our web servers to recognize you. We store information that we collect through cookies, log files, and/or clear gifs to record your preferences. Vendors and Service Providers. We may share information with a third-party vendor and service provider who provide services on our behalf, such as payment processing, order fulfillment, customer service, hosting the Services and providing database and server maintenance and security, and sending marketing and customer service communications on our behalf.

Legal Basis for Processing Personal Information

Security

Professor Mysterious is committed to protecting your information. To do so, we employ a variety of security technologies and measures designed to protect information from unauthorized access, use, or disclosure. The measures we use are designed to provide a level of security appropriate to the risk of processing your personal information. However, please bear in mind that the Internet cannot be guaranteed to be 100% secure.

Data Retention

We retain personal information we collect from you where we have an ongoing legitimate business need to do so (for example, to provide you with a service you have requested or to comply with applicable legal, tax, or accounting requirements).

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

Your Rights and Choices

You can use some of the features of the Services without registering or providing personal information, thereby limiting the type of information that we collect. Note, however, that by doing so you might not be able to access and use all of the functions and services.

If you are a registered user, you may access certain information associated with your Account by logging into your account through the site or email privacy@professormysterious.com. If you wish to terminate your Account all existing order information will remain stored on our 3rd party E-Commerce servers as well as any product reviews you submitted.

To protect your privacy and security, we may take reasonable steps to verify your identity before updating or removing your information. Your ability to access and correct your information may be temporarily limited where access and correction could: inhibit Professor Mysterious’ ability to comply with a legal obligation; inhibit Professor Mysterious’ ability to investigate, make or defend legal claims; result in disclosure of personal information about a third party; or result in breach of a contract or disclosure of trade secrets or other proprietary business information belonging to Professor Mysterious or a third party.

You may unsubscribe from receiving marketing emails from us at any time. If you wish to do so, simply follow the instructions found at the end of the e-mail. Even if you unsubscribe, we may still communicate with you via email for informational, transactional, account-related, or similar purposes.

Additional Rights Under the EU General Data Protection Regulation

If you are a resident of the EEA (European Economic Area), you have the following additional data protection rights:

  • If you wish to access, correct, update, or request deletion of your personal data, you can do so at any time, subject to certain exceptions, by emailing mel.eugdpr@professormysterious.com.
  • In addition, in certain circumstances, you can object to the processing of your personal data, ask us to restrict the processing of your personal data, or request portability of your personal data. Again, you can exercise these rights by emailing mel.eugdpr@professormysterious.com.
  • Similarly, if we have collected and processed your personal data with your consent, then you can withdraw your consent at any time. Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect the processing of your personal data conducted in reliance on lawful processing grounds other than consent.
  • You have the right to contact your local data protection authority about our collection and use of your personal information.

We respond to all requests we receive from individuals wishing to exercise their data protection rights in accordance with applicable data protection laws. We may take reasonable steps to verify your identity before responding to your request.

Under Age Privacy

Professor Mysterious does not collect information from those under the age of 18. Prior to accessing our site each user consents that they are of age (18+) to purchase our products before navigating to our home page.

International Data Transfers

When you access and use the Services, your information is transferred to the United States, where our servers are located. Please note that the data protection laws of some countries, such as the United States, may not offer a level of privacy protection equivalent to that within your home country.

For personal data we receive from the EEA, United Kingdom, and Switzerland, Mister-E-Liquid LLC & Professor Mysterious has certified its compliance with the EU-U.S. Privacy Shield Framework and the Swiss-U.S. Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal data from such countries. Professor Mysterious is committed to protecting your privacy. This Privacy Shield Notice sets out the privacy principles we follow with respect to transfers of personal data from the European Economic Area ("EEA"), United Kingdom, and Switzerland to the United States, including personal data we receive from individuals who visit our or our affiliates' web and mobile sites ("Websites"), who access or use our product or service offerings ("Services"), or who otherwise interact with us ("you").

Through the help of our Legal Council we are working to ensure we will comply with all the EU-US and Swiss-US Privacy Shield Frameworks as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal data from the EU, United Kingdom, and Switzerland. Types of Personal Data We Collect and Use

The types of personal data we may receive in the United States, as well as the purposes for which we collect and use it, are set out in our Privacy Policy.

In compliance with the Privacy Shield Principles, we commit to resolve complaints about our collection or use of your personal data. Shipping Policy

Most orders placed Monday through Thursday before 12:00 pm ET will ship same day. Most orders placed on Friday after 12:00 pm ET will be shipped the following Monday or, if a government holiday, on the next business day. Most orders placed on Saturday or Sunday will be shipped Monday. ProfessorMysterious.com ships all merchandise via the United States Postal Service or FedEx. Transit times vary based on shipping service selected. Please contact the selected shipping service for delivery date estimates.

International Orders

We can ship to virtually any address in the world. International orders have the option of FedEx or USPS. Please note that there are restrictions on some products, and some products cannot be sent to international destinations. International customers, before placing your order please consult your local laws on importing fog fluid.

Professor Mysterious will not be held responsible for packages that are lost in transit because of, but not limited to: errors made by the shipping company, errors made by the customer, confiscation by customs, etc. All international orders will be placed at the risk of the consumer due to lack of control over the package once it leaves US customs. For shipping insurance, please contact us before ordering.

Due to the cost of shipping for international packages, we are unable to offer the same warranty for our customers who have their packages outside of the US. Product will not be replaced. Instead, the customer will receive a store credit for any products determined to be DOA.

Free Shipping Offers

Free shipping offers only apply to the United States when applicable. Not applicable if adult signature is required for delivery.

Returns Policy

You may return most new, unopened items within 24 hours of delivery, for store credit or exact replacement of product, exclusively in the event that you received a defective, or incorrect product. We will pay the return shipping costs if the return is a result of our error. Shipping charges are not refunded unless product is being returned due to our error.

If your product is defective, you may be able to return it for an exchange. Items more than 50% used may not be exchanged. Fog Liquid and Scents cannot be returned or exchanged unless the error was ours. Returns are handled on a case-by-case basis and authorized at our discretion. Non-defective returns are subject to a 20% restocking fee.

Warranty on Fog Liquid and Scents

There is no warranty on Fog Liquid, unless the error is ours. All Fog Liquid and Scents must be inspected and tested by the customer upon receipt and the customer must notify us within 24 hours of the time stamped delivery if a product is found to be defective. The customer must notify us of defective Fog Liquid and Scents within 36 hours of receiving shipment to qualify for refund or replacement.

Incorrect Orders

Professor Mysterious is not responsible for orders that are placed incorrectly. We reserve the right to refuse returns or exchanges of products on orders that were filled as ordered. If you have questions or are unsure regarding a product or its function or compatibility please contact us before placing your order. We are more than willing to provide further product description, clear up any confusion, or provide advice about the products we sell.

If your order is received and contains incorrect items or is missing items, then you must notify us within 24 hours of receipt of the package. We will certainly fix any mistakes that we have made, but we must be notified in a timely manner.
